Stand-by mediation

Many seasoned litigators use stand-by mediators on an on-call basis either during an arbitration or during crucial phases of a litigation.  A stand-by mediator can ease the transition to negotiation and may be able to spot opportunities to find a settlement acceptable to both sides (or multiple sides) of a dispute before the parties ask for settlement talks.

Stand-by mediation can save parties money where the possibility of settlement is not obvious but is real to an experienced hand.  Parties in high stakes arbitrations or litigations may want to consider this option.
